There are two types of courts in the UAE, ie, federal (the Emirates of Abu Dhabi, Sharjah, Fujairah, Ajman, and Umm Al Quwain) and local (the Emirates of Dubai and Ras Al Khaimah, which have retained their independent judiciaries). Both federal and local courts comply with the UAE Temporary Constitution of 1972. Both federal and local court systems are composed of three levels, ie, courts of first instance, courts of appeal, and the Federal High Court in Abu Dhabi or the Court of Cassation in the Emirate of Dubai. In the Emirate of Ras Al Khaimah, the judiciary is of two levels only, ie, courts of first instance and a court of appeal.

The Civil Procedure Act regulates the jurisdiction of the federal courts, their formation, and level in the hierarchy. The Act is applicable to all civil proceedings before the courts, ie, civil, commercial, and personal. Although the courts in the Emirate of Dubai are formed under and regulated by Act Number 3 of 1992, the Civil Procedure Act has been adopted and enforced in Dubai pursuant to Act Number 5 of 1992.

How can I endorse spouse name in my Passport?

 

To endorse spouse’s name in the Passport, the following procedures to be completed at Indian Embassy/Consulate:

* Application in EAP-II Form

* Four recent photos with white background and frontal view.(5cmx5cm)

* Present Passport of both husband and wife in original with a photocopy each of first, last & page containing valid visa. If the wife is out of UAE her passport copy will be accepted.

* Marriage Certificate issued by Registrar of Marriage duly attested by the Home Department of the concerned State in India or Ministry of External Affairs, Delhi with any state home department.

* Marriage Affidavit will not be accepted.

NOTE: MEA additional seal with ‘The Ministry of External Affairs accepts no responsibility for the contents of the above documents’ will not be accepted by the Consulate for this purpose. In that case, concerned state home department attestation is required or attach wife’s passport copy which has already been endorsed spouse name.

* Personal appearance of applicant is compulsory to establish physical identity.

* Personal Particulars Form (4 copies with pasted photos) to be filled.


Passport Will be retained during the Tenure the Service.

* If you are doing more than one change in a time (eg. spouse endorse and address change), Consulate will issue new book instead of endorsing in the same passport.

NOTE: If both husband and wife are in UAE, a Joint Marriage Affidavit can be made from IVS Attestation Centre, instead of attesting Marriage Certificate from the concerned state home department.

Required Documents for Joint Marriage Affidavit:

* Original Passports of husband and wife

* Marriage Certificate

* Joint Photo of husband and wife

* Filled form which is available at the Consulate (can be filled by hand)

* Physical presence of husband and wife
