There are two types of courts in the UAE, ie, federal (the Emirates of Abu Dhabi, Sharjah, Fujairah, Ajman, and Umm Al Quwain) and local (the Emirates of Dubai and Ras Al Khaimah, which have retained their independent judiciaries). Both federal and local courts comply with the UAE Temporary Constitution of 1972. Both federal and local court systems are composed of three levels, ie, courts of first instance, courts of appeal, and the Federal High Court in Abu Dhabi or the Court of Cassation in the Emirate of Dubai. In the Emirate of Ras Al Khaimah, the judiciary is of two levels only, ie, courts of first instance and a court of appeal.

The Civil Procedure Act regulates the jurisdiction of the federal courts, their formation, and level in the hierarchy. The Act is applicable to all civil proceedings before the courts, ie, civil, commercial, and personal. Although the courts in the Emirate of Dubai are formed under and regulated by Act Number 3 of 1992, the Civil Procedure Act has been adopted and enforced in Dubai pursuant to Act Number 5 of 1992.

All types of private educational institutions in Dubai are controlled by Knowledge and Human Development Authority (KHDA).

Required Documents for a New Educational Permit

The following documents are required from the applicant along with the Application for Education Permit. Documents to be Notarised and/or Legalised (as indicated).

Initial Requirements

* Application Form

* Application Fees

* Business Plan (elements/structure provided)

* Copy of the Agreements with the Certifying Body for Courses or any documents supporting application (if applicable)

For Individuals

* Valid Passport Copy of individual shareholder(s) and Manager of the institution

* Resume of Manager of the institution

* Specimen Signature of individual shareholder(s) and Manager of the institute (template provided)

For Corporations

* Original or Notarized copy of valid Commercial License/Certificate of Incorporation
* Notarized Board Resolution calling for the establishment of Training Institute, and appointing Manager/Representative
* For Managers/Representatives, Natural person documents apply.

Remarks

* Trade Name reservation from the relevant commercial authority has to be submitted before the issuance of NOC to commercial authority.
* Signed undertaking by the applicant, has to be submitted before the submission of NOC to commercial authority.

* In case applicant is an embassy/consulate, an NOC from the Ministry of Foreign Affairs is required.

* Following the approval of the business plan, the applicant will receive an NOC from KHDA in order to register with the relevant commercial authority.

* The following documents are to be submitted within 60 days from the issuance of the NOC

Final Requirements

* Copy of the Commercial License from DED or Free Zone Authority (as applicable)

* Copy of the Environment, Health and Safety (EHS) Certificate

* Premises Location Map

Notes
* All Powers of Attorney need to be accompanied with a passport copy.

* KHDA reserves the right to call for any extra documents it may require, where
necessary.

* KHDA reserves the right to ask for attestation by UAE Embassy or other Embassies, as may be necessary.

* Board Resolution and/or Power of Attorney for the Permit holder must state the Permit holder’s full name, nationality and passport number.

* All official documents must be either in Arabic or English. Documents in any other languages must be accompanied by a certified English or Arabic translation
